These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and ROGO Analytics LLC ("we," "us" or "our"), concerning your access to and use of the rogoanalytics.ai website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the "Site").
You agree that by accessing the Site, you have read, understood, and agree to be bound by all of these Terms of Service. If you do not agree with all of these Terms of Service, then you are expressly prohibited from using the Site and you must discontinue use immediately.
Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws of the United States, foreign jurisdictions, and international conventions.
Custom Prototypes ("Working Proofs"): Any custom prototypes, working proofs, or tailored solutions developed specifically for a client remain the intellectual property of ROGO Analytics LLC unless explicitly transferred under a separate, formalized enterprise Service Level Agreement (SLA) or Master Services Agreement (MSA). Clients are granted a limited, non-exclusive, non-transferable, revocable license to evaluate such prototypes internally for feasibility assessment.
3.1 Strict Data Ring-Fencing: We recognize the critical importance of enterprise data security. ROGO Analytics LLC strictly ring-fences your data. We explicitly guarantee that we do not use enterprise client data to train, retrain, or improve any public-facing or generalized AI models. Your proprietary data remains yours.
3.2 "As-Is" Generative Outputs: Our Executive Command Center tools and AI-generated outputs are provided on an "as-is" and "as-available" basis. While we strive for absolute precision and utilize advanced retrieval-augmented generation architectures, AI systems are fundamentally probabilistic. Clients retain ultimate, non-delegable responsibility for verifying all algorithmic insights before executing any business, financial, operational, or legal decisions based on those outputs.
In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the site, even if we have been advised of the possibility of such damages.
Notwithstanding anything to the contrary contained herein, our liability to you for any cause whatsoever and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to us during the six (6) month period prior to any cause of action arising.
